Foreign investors now fully exempt from capital gains tax on govt securities

The Centre has issued the Income Tax (Amendment) Ordinance 2026, which fully exempts foreign investors from capital gains tax on government securities. The exemption covers interest earned on securities and capital gains arising from their sale, exchange or transfer, and removes the 12.5% LTCG and 20% withholding tax on interest income. Govt allows overseas individuals to invest in equities via PIS

The government has notified the Foreign Exchange Management (Non-Debt Instruments) (Third Amendment) Rules, 2026, allowing individual Persons Resident Outside India (PROIs) to invest in Indian equities through the Portfolio Investment Scheme (PIS). The investment limit has been raised from 5% to 10% in any company. Earlier, this route was available only to NRIs and OCIs.
